It seems clear from the foregoing that jurisprudence isn’t and could not be a one line or one question subject. Thus, as Patterson warned and incursioned into jurisprudence, is always an adventure and idea in which the adventurer must pick his way among incongruent terminologies. It is this apparently complicated, yet flexible nature of jurisprudence that the author of the book “LAW IN OUR SOCIETY,” had in mind when he stated that “Jurist are majorly lawyers so trained in the rhetoric of controversy with; (1). Its selective favourable posing of issues, (2). Its selective coloring, argumentative arrangement of fact. (3). It use of epithet and innuendo and (4). Its typical, complete distortion of the advocate vision. So that it ceases to even take in any possibility which would work against him. In Jurisprudence, every man states his own issue, misstates the other man issue, beclouds his or any issue, etc…uncontrolled by procedure or by answer or by authority. 1. Uses his rhetoric almost without control. 2. He is free to dream of facts even by anonymous imputation. 3. Consequently always rides his straw man down”
The learned author then ended up on this pertinent note; “whereas in law, one party always loses or each must yield something. In jurisprudence, there us this triumphant victory for all. This makes for comfort, if not for light.”
While the cynicism in the above passage cannot be over stretched it seems also true, and this will become manifest soon, that jurisprudence is in good measure the art of being methodically ignorant of what everybody knows. Again without over stretching the analogy, in some respects jurisprudence can be likened to the tale of the Shakespearian fool which is said to be “full of sound and fury but signifying nothing”. A case of much ado about nothing. It is in this circumstance that DIAS‟ counsel of caution has more than a fleeting relevance. According to him “the best guarantee of independence and originality in thought is breath of view, a sense of perspective and a sympathetic appreciation of what people have said and are saying. No one theory provides the best or exclusive avenue to truth” and those who choose to tread one path rather than another are not for that reason misguided and in darkness. Jurisprudence is a wide field crossed by many paths or being superior to another since much depends on wither one wishes to go”
