The mode through which land is acquired is of the utmost importance as in an action for declaration of title to land, the claimant must be able to trace his title to the original owner.

MODES OF ACQUIRING TITLE

Note that title to land can be acquired in the following ways:

a) By Settlement:

This means that the person who first settled on land free of claim is its rightful owner

b) By Sale:

This is a permanent transfer of ownership for monetary consideration and discharges the original owner from all interest, benefit and claim

c) By Gift:

This can be either absolute or conditional and it transfers all rights and interest to the person gifted. Furthermore, any person claiming ownership to the land must prove it was an absolute gift and not a conditional gift
